§ 17.56.080. Waivers.

    Approval Criteria. The Planning Director is authorized to grant a waiver from the setback or height requirements when the strict or literal interpretation and enforcement of a particular regulation would result in practical difficulty in complying with a requirement due to a unique feature of the building, or site configuration that would cause the signage permitted by this chapter to be ineffective in identifying a use or structure that would otherwise be entitled to a sign and, where the change does not exceed twenty (20) percent of the setback or sign height, provided that the requested change does not create a hazard.

    B.

    Findings Required. A waiver may be granted if the following findings are made:

    1.

    The landscape plan mitigates the overall visual impact of the signage proposed; and/or

    2.

    The sign design and quality otherwise complies with the requirements of this chapter and meets the intent of the Sign Code.
