§ 17.56.020. Definitions.

  • As used in this chapter:

    "Animated sign" means a sign with motion, action of flashing or other light and color changes, which is activated by mechanical, electrical or other non-natural means.

    "Attached/Wall sign" means a sign attached to, or applied on, and totally supported by a part of the building that does not extend beyond any edge of the wall or the roofline. Attached/Wall signs do not include canopy, awning or freestanding signs.

    "Awning/Canopy sign" means a sign sewn or otherwise mounted on an awning.

    "Bandit sign" means a sign of any material that is attached to a fence, utility pole, tree, traffic sign post, retaining wall or any object located, situated on, or visible from public or private rights-of-ways or property.

    "Banner" means a sign made of cloth, canvas, or flexible material which directs attention to a business, commodity, service, entertainment, or attraction.

    "Building frontage and length" means the length of the exterior wall in linear feet where the sign is to be placed. For a multi-tenant building, building frontage is the space that the business occupies.

    "Business establishment" means any business or non-profit organization where business is conducted, goods are made, stored, or processed, or where services are rendered.

    "Business sign" means a sign that directs attention to a business, profession, service, product, activity, or entertainment sold or offered upon the premises where such sign is located. The sign may include the name of the property or business, in addition to directional information.

    "Cabinet sign" means a sign that contains text and/or logo symbols within a single enclosed cabinet.

    "Change of copy" means a change of business name, color, element, logo, and/or the use to which the sign pertains.

    "Directional sign" means:

    a.

    A noncommercial sign permanently erected and maintained by the Town, county or state, or any agency thereof, to denote the name of any thoroughfare, the route to any town, educational institution, public building, park, recreational facility or hospital; to direct and regulate traffic, to denote any transportation or transmission company for the direction or safety of the public.

    b.

    A noncommercial sign located on and relating to an activity on the premises upon which the sign is located, providing information to pedestrian and vehicular traffic, e.g., "entrance," "exit," "caution" "no trespassing", and other similar informational signs as approved by the Planning Department.

    "Directory sign" means a sign on which the names and locations of occupants or the use of a building is given.

    "Display (sign) area" means the area described in Section 17.56.220 'Computation of Sign Area'.

    "Flashing sign" means any sign whose display changes that is used for identification, direction, advertising, or promotional purposes, that includes lighting fixtures which flash, blink, or cut on and off intermittently, and which is used as an exterior sign or an interior sign visible from the public right-of-way.

    "Freestanding sign" means a sign that is supported by one or more columns or pedestals, extended from the ground or from an object on the ground, where no part of the sign is attached to any part of a building, structure or other sign.

    "Freeway oriented business" means businesses located within five hundred (500) feet of the nearest right-of-way line of Interstate 25 such as, and not limited to:

    a.

    Automobile and truck refueling stations;

    b.

    Restaurants; and

    c.

    Lodging establishments.

    "Illuminated sign" means any sign which is directly lit by an electrical source, internal or external, not including signs which are illuminated by street lights or other light.

    "Marquee sign" means any changeable letter sign attached to and made a part of a marquee. A marquee is defined as a permanent roof-like structure projecting beyond or above a building wall at any entrance to a building or extending along and projecting beyond the building's wall and generally designed and constructed to provide protection from the weather.

    "Master plan, sign" means a comprehensive, narrative description of allowed sign types, and scaled drawings of any building, lot, parcel, collection of parcels or other premises, showing the number, size, description, color, materials and location of all signs thereon.

    "Monument sign" means a freestanding sign attached to the ground by a base or support(s) designed as an architectural unit of the sign.

    "Moving sign" means any sign which moves to attract attention, or includes any visible, rotating or revolving parts, including any device that is activated by wind or forced air

    "Multi-tenant building" means buildings where multiple tenants exist in a single building, and each tenant has an individual and separate primary exterior entrance.

    "Nonconforming sign" means any sign which does not conform to the regulations of this Code.

    "Nonconforming sign, illegal" means that at the time of its establishment, a sign, without limitation of type, explicitly did not comply with the regulations in this Section.

    "Nonconforming sign, legal" means any sign that has been granted a waiver or was legally established prior to the creation of the regulations in this Section.

    "Non-profit special event sign" means a temporary sign which carries information about a non-profit special event, but not including any business sign or real estate sign, such as a "sale" sign at a store.

    "Off-premise sign" means any sign which serves to communicate information about a business, product, service or activity not conducted, sold or offered on the premises on which the sign is located, including adjacent public or private rights-of-ways.

    "Outdoor advertising" means any medium, device, or sign which advertises a place, product, service or anything that is not available on the premises on which the medium, device, or sign is located.

    "Pennant" means a series of small triangular shaped or forked shaped flags that are joined together on a string, cord, or other fastener.

    "Professional name plate" means a sign denoting only the name, occupation and address of an occupant in a commercial, public, or institutional building.

    "Political and campaign sign" means any sign which indicates the name, cause or affiliation of anyone currently seeking public office or political issue to be voted upon in an upcoming election.

    "Projecting sign" means a sign attached to a building or beyond the surface of the building to which the sign is attached, and projecting from the building to which the sign is attached.

    "Public interest sign" means a sign to regulate traffic, provide information, required to be posted by law, or posted by governmental agencies when required to protect the public health, safety and welfare.

    "Real estate sign" means a sign indicating the availability for sale, rent or lease of a specific lot, building or portion of a building or a group of homes (as in models) upon which the sign is erected or displayed.

    "Roof line" means the juncture of the roof and the perimeter wall of the structure.

    "Roof sign" means any sign erected or constructed or painted wholly or partly upon or over the roof of any building or supported solely on the roof structure.

    "Sandwich sign" means a double faced, temporary sign, which is not permanently ground mounted or affixed to any structure on site, and is designed in the shape of an "A."

    "Shopping center" means a group of two or more commercial units developed and generally managed as a common unit with shared parking facilities and/or access.

    "Sign" means any object or devise containing letters, figures, and/or other means of communication or part thereof, situated outdoors or indoors, of which the effect produced is to advertise, announce, communicate, identify, declare, demonstrate, direct, display, and/or instruct potential users of a use, product, event, and/or service.

    "Sign face" means the surface of a sign that the message is displayed or illustrated.

    "Special event sign" means any sign advertising a special event for public or private activities

    "Streamer" means a ribbon or series of pennants used to attract attention to a product or service.

    "Subdivision identification sign" means a freestanding or wall sign that could be attached to a subdivision boundary identifying a recognized subdivision, condominium or apartment complex, residential development, or office/business park.

    "Temporary sign" means any sign device, banner, pennant, flag (excluding governmental flags and corporate flags), or advertising display constructed of cloth, canvas, light fabric, cardboard, wallboard or other light material, with or without a frame, that is not permanently affixed to a building or the ground.

    "Time-temperature-date sign" means a sign that displays the time, outdoor temperature, date of the month, and/or the American Flag.

    "Under awning/canopy sign" means a sign with a single or double face copy hung below an awning or canopy of the business being identified.

    "Wind sign" means a sign consisting of one (1) or more banners, flags, pennants, ribbons, spinners, streamers, captive balloons or other objects or material fastened in such a manner as to move or be designed to move upon being subjected to pressure by wind or air movement.

    "Window sign" means any sign placed inside or upon a window facing the outside of the building which sign is intended to be seen from the exterior of the building but excludes merchandise and/or mannequins included in a window display.

    "Yard" means:

    1.

    An open space other than a court, on a lot, unoccupied and unobstructed from the ground upward, except as otherwise provided in this title.

    2.

    "Front yard" means a yard extending across the full width of the lot between the front lot line and the nearest line or point of the building.

    3.

    "Rear yard" means a yard extending across the full width of the lot between the rear lot line and the nearest line or point of the building.

    4.

    "Side yard" means an open space between a main building and the side lot line, extending from the front yard to the rear yard, the width of which is the horizontal distance from the nearest point of the side lot line to the nearest point of the main building.
