§ 17.05.080. Cannot be perceptible.
The odor of marijuana shall not be detectable by a person with a typical sense of smell from any adjoining lot, parcel, tract, public right-of-way, or building unit. Personal cultivation of marijuana shall not be perceptible from the exterior of the residence visually or as a result of undue parking or vehicular or foot traffic, including but not limited to:
1.
Common visual observation, which precludes signage of any form;
2.
Unusual odors, smells, fragrances, or other olfactory stimulus;
3.
Light pollution, glare, or brightness that disturbs the repose of another;
4.
Undue vehicular or foot traffic, including excess parking within the residential zone; and
5.
Noise from fans in excess of Town of Monument Municipal Code Sections 8.20.040 and 9.12.030.
